NT Educare serves the right to change or revise the terms and conditions of this Agreement at any time by posting any changes or a revised Agreement on this Website. For parents/students Service

The company is committed to get parents highly qualified teachers but we do not guarantee that teacher would improve the results of the student. We believe in mutual efforts and we advice that both parties should participate in an equal way to improve the outcomes. Parents are equally responsible for the good or bad academic results of their kids and we recommend that parents should spend a little time in motivating their kid as teacher alone cannot bring the best results as the tutor spends only a few hours a week with the kid. In no case, The Company will be responsible for the poor academic results of the students. We only guarantee to do our best on our part to help the students find qualified teachers.We are giving tutors who are screened, tested for their knowledge and teaching ability. Their credentials and certificates are verified as to authentically and genuineness, however all the checking is done in good faith.we are not responsible if they have given us false information and we verified it.

The following has to beabide by the Parents/Students:

• Definitions: In these Terms and conditions the following definitions apply:
  
  
  • CLIENT: This term means the family/individual requiring the home tutorial services to his/her relative or the self.
  • TUTORING ASSIGNMENT: This term implies the period during which the TUTOR is supplied to render tutoring services to the CLIENT.
  • TUTOR: Tutor is an individual deputed by NT Educare LLP to render home tutorial services to the client.
  • CLIENT: This term means the family/individual requiring the home tutorial services to his/her relative or the self.
• The Parents/students agrees to enter into the contract of taking any one of the below mentioned services:
  
  
  • Quarterly Package
  • Half Yearly Package
  • Yearly Package
  • Customized Package
• The companywill match students with tutors by personality, by screening the correct tutor and according to their educational needs. However, if the student is not comfortable with the tutor we will be replacing the tutor. And if the tutor does not want to continue the tuition company holds the right for replacing the tutor.
• Tutors at company are given extensive instruction in our instructional methods. By signing below, the Parents/Students agree that he/she will not solicit any TUTOR of company to perform the same or similar services outside of company. You (the Parents/Students) agree that if you do, company can immediately terminate your contract, retain any fees and deposits you have paid and pursue all other rights and legal remedies it has.
• Parents/Students agree to give company at least one month’s written notice of his/her intent to terminate tutoring.
  
  Commencing the day we receive written notification, Parents/Students will be financially responsible for the lessons that normally occur (according to your regular tutoring schedule) within the following two-week period. If you have not yet paid for lessons, you must do so according to the payment schedule.
• When we (Company) must cancel a lesson for any reason including a tutor’s illness or other unavailability, you (CLIENT/Parents/Students) will be offered a make-up lesson scheduled at the convenience of you and the tutor.
• The progress of each student is of foremost concern to company. The Parents/Students agrees to report the negative progress (if any) of the student to company without delay.
• Initially the company will take fees for 3months in advance. If incase, the Parents/Students wants to discontinuation of the course the Parents/Studentshas to intimate the company within 30days notice. If not the company will forfeit the balance amount or give a service in its place.
• An adult (Parents/Guardian) should always be present for tutoring sessions if the student is under the age of eighteen (18).
• Fee once paid will not be Refunded, Adjusted or Transferred under any circumstance and parents should not approach for this.

Payments

The company reserves the right to manage the payment of all tutors. Rates are fixed and strictly non-negotiable.There is no way of paying the tutor on our behalf. The Company will deduct a suitable proportion of the fees paid by the parent/student for connecting with the tutor, before making the final payment to the tutor. This proportion will be conveyed to the tutor and may wary on a case-to-case basis on sole discretion of the Company.Tutors are strictly banned to collect payments from the parents/ students. If you decide to make a payment to the tutor directly and the tutor decides to defaults on their work company will not be responsible, then you and only you would be responsible for any sort losses. Payment are not negotiable but under certain circumstances on company decision discount can be given For instance If two or three friends joining in, they expect discounts – the negotiation will have to be done with the company for it.

We highly advise that parents should keep the receipt or transaction id as a proof that they have made the payment. This receipt will prove to be helpful in verifying your payment.

Location

Tuition sessions will be held at parents place (mutually agreed place by the Parents. In any case tuitions can’t be held at tutor’s place). However, if you suggest any other place for the tuition i.e your friends place, we can make arrangements for this too.The company will not be responsible if the given location is occupied or not vacant to be used for the lessons and it will still be counted as a paid lesson.

Responsibility

Tutors are assigned by our company after matching for the need of the student and parents, all aspects are considered before he is allotted the work. Then he has to conduct a demo at parent’s place for the child and take his test. After this is over and the parents are satisfied the relationship starts. Further, any claims regarding any injury, damage or loss while attending the home tuition will not be counted in our responsibilities. This exception is also applicable to all cost and expenses incurred as a result of such claims. We are just a firm for arranging tutors and we are not subjected to pay any losses. If tutor found involved in loss and damage to the property of the client, he will be charged to pay the losses. You also understand that the tutor will teach your child if and only if at least one parent is present in the house.

Termination

If a registered parent / student want to discontinue the services of a tutor after selecting him / her for the assignment, In no case payment is to be done to the teacher. The payment must be done to the company.

Limitation of Liability

In the event of litigation, The Company’s total liability shall not exceed the amount of money Student paid to the company for services rendered.

For Tutor

The following are to be abided by the Tutor:

• Tutor should carry the DAILYLOG SHEET everyday with him to the client’s place and get the client signature everyday without fail.
• Salary will be provided to the TUTOR only at the proof of the DAILYLOG SHEET.
• TUTOR is asked to give few demo classes at the starting of assignments and if the client is unhappy with the tutoring and asks for replacement, salary will not be given for the demo classes but incase the tutor’s demo charges it will be decided in consultation with the company's counselor. If the tutor is successful the company will pay for it otherwise not.
• Once the TUTOR starts assignment with company he/she should continue at least for 6months else a deduction in salary will be applicable.
• The TUTOR is not entitled to receive payment from company, whether in respect of holiday, illness or absence unless agreed by the company.
• Tutor shall abide by the additional clauses mentioned below:
  
  
  • TUTOR agrees to regularly update the company on progress that student is making and also the details regarding related matters of performance evaluation test to monitor the progress of the studies to be conducted at frequent intervals and parents as well as Institute must be informed of the progress.
  • If there is negative impact inthe student’sprogress, TUTOR shallimmediatelybringthisto company’s notice.
  • The tutorshould not seek any personal favor from any family members of the students.
  • The tutorshould observe Ordinary courtesies as are commonly practiced in respectable family.
  • The tutorwill not create competition for NT in way including providing tuitions personally or through other persons to NT”s clients independently.
  • In case of any complaint or problems it is expected that the NT tutor will directly talk to the manager (counselor) in the office rather than the student or the parents.
  • Organization expects from all and every teachers /professors to be punctual /regular on time for expected assignment.
  • You (Tutor) will be paid between 10-15th of every month of each assignment done in the previous month (Payment cycle is from 1st –last day of the month).
  • Tutors are requested to submit the attendance card latest by 5thof every month for the purpose of processing the payments. If the attendance card is not submitted in time the payments would be delayed.
  • In no case is the tutor authorized or allowed to discuss, modify, adjust, rephrase, renew in any way the charges , tuition fees or any other terms with the parents or their representatives or the students. You will be responsible if anything goes wrong to continue assignments smoothly. The tutor will have to indemnify the company for any losses or damages suffered by the company due to his actions.
  • Revising yourself thoroughly before any class will be helpful to you. Your co-operation to the organization (company) will be helpful to grow both of us. Revise, plan and prepare.

Payments

The payment to the tutor will be made by the company.Tutors are strictly banned to collect payments from the parents/ students. The registered parent/student will never give or make payments to the Tutor.The Company will deduct a suitable proportion of the fees paid by the parent/student for connecting with the tutor, before making the final payment to the tutor. This proportion will be conveyed to the tutor and may wary on a case-to-case basis on sole discretion of the Company.

Background check:

The company reserves the right to carry out both regular and random discreet background / reference checks, as part of its routine operating procedure, without giving any justification to the tutor or anybody else. The registered parents have the right to ask for your id & address proof along with photograph(s) if their building / society entry norms require it. They also have the right to ask for it from a tutor to double check with the company.

Damages:

The company is not responsible for any unforeseen, intentional or unintentional accidental damage caused by the tutor(s) to any living or non-living entity in the house of the parent / student.

Safety Norms:

The company is also not responsible for any behavioral misconduct by the student or their house members including the support staff employed by the student or his / her parents. However, incidents of misbehavior, harassment if any, should be reported to the company, at the earliest possible. Female home tutors should take enough care and make an intuitive decision before taking up an assignment to avoid any kind of future embarrassing scenarios. The company cannot be held responsible for any such unforeseen and unfortunate event if any.

Termination:

If the registered tutor wants to discontinue an assignment of our registered student / parent then he/she needs to give an adequate notice by e-mail and written letter to the officially notified address of the companyso that his /her dues will be held back until the final settlement is done.

Limitation of Liability:

In the event of litigation, thecompany total liability shall not exceed the amount of money student paid to the company for services rendered.

Confidentiality:

The tutor is of the understanding that he or she must not at any time during this agreement, or for a period of three years after this agreement terminates, disclose to any person any confidential information that concerns the affairs, customers, clients, business or suppliers of the company . The only exception being that you may disclose any of the company’sconfidential information if required to by law or any government or regulatory authority. None of the companys confidential information can be used for anything that does not directly help you to perform your obligation to this agreement.

Tutor Registration can be cancelled without notification on :-

• Any misconduct to the Client or us.
• Consecutive Failure of 2 assignments by any reason. 3rd chance may be considered in specific circumstances.
• Absentee for a long duration without notice.
• Diverting from the above rule

Use of Website:

NT Educare is not responsible for any damages resulting from use of this website by anyone. You will not use the Website for illegal purposes. You will (1) abide by all applicable local, state, national, and international laws and regulations in your use of the Website (including laws regarding intellectual property), (2) not interfere with or disrupt the use and enjoyment of the Website by other users, (3) not resell material on the Website, (4) not engage, directly or indirectly, in transmission of "spam", chain letters, junk mail or any other type of unsolicited communication, and (5) not defame, harass, abuse, or disrupt other users of the Website.

NT Educare will have the right to participate in any defense by you of a third-party claim related to your use of any of the Website content or Products, with counsel of NT Educare choice at its expense. NT Educare will reasonably cooperate in any defense by you of a third-party claim at your request and expense. You will have sole responsibility to defend NT Educare against any claim, but you must receive NT Educare prior written consent regarding any related settlement. General:

• Force Majeure:  NT Educare will not be deemed in default hereunder or held responsible for any cessation, interruption or delay in the performance of its obligations hereunder due to earthquake, flood, fire, storm, natural disaster, act of God, war, terrorism, armed conflict, labor strike, lockout, or boycott.
• Cessation of Operation:  NT Educare may at any time, in its sole discretion and without advance notice to you, cease operation of the Website and distribution of the Products.

This Agreement will be governed by the laws of the State of Maharashtra without regard to its conflict of law principles to the contrary. Neither you nor NT Educare will commence or prosecute any suit, proceeding or claim to enforce the provisions of this Agreement, to recover damages for breach of or default of this Agreement, or otherwise arising under or by reason of this Agreement, other than in courts located in State of Maharashtra. By using this Website or ordering Products, you consent to the jurisdiction and venue of such courts in connection with any action, suit, proceeding or claim arising under or by reason of this Agreement. You hereby waive any right to trial by jury arising out of this Agreement and any related documents.
